5th Regiment Virginia Militia

May 5, 1813

Norfolk brigade headquarters, May 5, 1813. 

 Pursuant to the General Orders of the 1st March from the Governor of Virginia vesting in General Taylor authority to organize the army at this place; Brigadier General Taylor has the honor to submit to Major General Hampton the following plan of organization of the troops called out in the late requisition. The Rifleman Light Infantry and Infantry of the line shall be formed into Two Regiments, the one to be called the 4th and the other the 5th Regiment; each Regiment shall consist of eight companies of the line, one company of Rifleman and one of Light Infantry; the regiment to be as nearly equal in point of strength as in conveniently practical. 

 By lot the following companies are assigned to the 4th Regiment viz. Capt. Roberts Rifle Company, Captain Buckmaster and Captain Jeffries Light Infantry, Captain Brents, Laws’, Holiday’s, Woods, Lacy’s, Gregg's Infantry of the line – – – The 5th Regiment will be composed of Captain Mason’s Rifle, Captains Proctor’s and Delany's Lite Infantry and Capt. Edward’s, McCormack, Allen, Nall, Walton, Davenport, Osborne's & Lt. Lampkin's Infantry of the line. 

 The Light Infantry Corps commanded by Capt. Jeffries and Delany containing each a less number of men then are required by law to constitute a company, cannot not conveniently with law or the regulations of the army be continued as separate and distinct corps, but the commanding general being desirous to preserve the Original Character of these troops unites them with the two other Light Infantry companies viz. Delany's to Proctor’s and Jeffries to Buckmaster’s. The Infantry companies in each Regiment will be formed into eight companies and equalized by draft under the orders of the respective commandants of Regiments, 

 It being understood however that the uniform companies are to be permitted to remain entire - - Col. Beaty Majors Waggoner and Connor are assigned to the 4th Regiment. Col. Mason Majors Hill and Miller are assigned to the 5th Regiment. The subalturns now commissioned officers and music will go with their captains. The troops of the new requisition now at Hampton will form a separate Battalion under the command of Major Crutchfield who will organize them. The foregoing plan having been submitted to Major General Thompson is approved and confirmed by him, and he directs Brigadier General Taylor to a carry it into immediate operation.

 The 4th Regiment under the command of Col. Beaty will be station in the rear of Fort Norfolk. The 5th under the command of Col. Mason will be stationed at a convenient ground to be selected by Col. Mason in rear of Fort Norfolk. The troops attached to these Regimens will tomorrow at 9 o'clock March with all their baggage to the stationed assigned to their different regimens., 

 Commandants of these Regiments will proceed forthwith to execute the organization as prescribed in above general orders and report the result together with a lot of the company officers and dates of their commissions to the Brigade Inspector.
